Terms of service
These terms of service apply to the use of Sealed Print. The provider is Tiny Tools Microservices GmbH, Fichtenweg 12, 28832 Achim (“we”).
The German version of these terms is binding. Versions in other languages are for information only.
1. Scope
These terms apply to all contracts on the use of Sealed Print between us and our customers (“customer”). Customers can be consumers within the meaning of § 13 BGB (German Civil Code) or businesses within the meaning of § 14 BGB. Provisions that apply only to consumers or only to businesses are marked as such.
Deviating, conflicting or supplementary terms of a business customer do not become part of the contract, even if we do not expressly object to them.
The customer is the person or company for which an organization is created in Sealed Print. Whoever creates an organization for a company confirms that they are authorized to do so.
2. Services
Sealed Print is a cloud printing service. Customers receive personal printer URLs that computers can print to via IPP, as well as web upload and a REST API. Jobs are stored with us, converted to PDF and delivered to destinations: through the Sealed Print relay client to printers of a computer or NAS, to INFRA-capable printers or via IPP to printers reachable on the internet. The features of each plan are those shown on the pricing page at the time of the order.
Documents are encrypted in transit and in our storage. For jobs sent to printer URLs (IPP) we do not offer end-to-end encryption: we process the documents on our servers to convert and deliver them. We delete stored documents no later than seven days after a job is finished.
We strive for high availability but do not owe any particular availability. We carry out maintenance at times of low usage where possible. The customer's printers, computers and networks are responsible for the printed output itself; faults there are beyond our control.
The relay client is provided free of charge for use under the contract and updates itself automatically unless the customer turns this off.
3. Registration and conclusion of the contract
By registering and accepting these terms, the customer concludes a contract on the use of the free plan Free. The contract is concluded when we activate the account.
The customer orders a paid plan in the web app under Settings → Billing. Before the order, the plan, prices, billing period and term are summarized; entries can be corrected until then. By clicking “Order with obligation to pay”, the customer makes a binding offer. We accept it by activating the plan and confirm the contract by email together with these terms and the withdrawal policy.
Where additional members cause costs, the customer orders them just as expressly via an “Order with obligation to pay” button.
The language of the contract is German. We store the text of the contract; the current terms are available on this page at any time.
4. Prices and payment
The prices on the pricing page at the time of the order apply. They are final prices and include VAT where it applies. Where no German VAT applies (reverse charge procedure for businesses in the EU with a valid VAT ID, customers outside the EU), the price shown is the amount payable without VAT.
Customers with a billing address in a country that uses the euro pay in euros, all others in US dollars.
The base price and additional members are charged monthly in advance; documents beyond the included monthly volume are charged monthly in arrears according to actual usage. If the number of members changes during a month, it is charged pro rata.
On the Free plan, documents beyond the included monthly volume are not delivered but held until the next month.
Payments are processed by our payment service provider Stripe. We provide invoices electronically. If a payment fails, we may restrict the paid services after a prior reminder until payment is received.
5. Term, termination and plan changes
Paid plans run for one month at a time and renew automatically for another month unless terminated. The customer can terminate at any time with effect from the end of the current billing month: in the web app under Settings → Billing, in the customer portal, via the page “Cancel contracts here” or in text form (e.g. by email to [email protected]). After a paid plan ends, the Free plan applies again.
The customer can terminate the Free plan at any time by deleting the organization or by informing us in text form.
We can terminate paid plans with one month's notice to the end of a month and the Free plan with two weeks' notice.
A change to a higher plan takes effect immediately and is charged pro rata. A change to a lower plan takes effect at the end of the current billing month.
The right of both parties to terminate without notice for good cause remains unaffected, in particular in the case of serious breaches of section 6 or persistent default of payment.
After the contract ends, we delete the organization's data unless statutory retention obligations apply.
6. Customer obligations
The customer uses Sealed Print only within the law. The customer does not transmit content whose processing infringes the rights of third parties or is a criminal offence, and no malware.
Printer URLs, API tokens and device credentials must be kept confidential like passwords. Anyone who knows them can send jobs. If misuse is suspected, the customer revokes them in the web app and informs us.
The customer installs the relay client only on devices they are entitled to use and shares only printers they are allowed to use. The customer is responsible for the members of their organization and their actions.
The customer must not use Sealed Print in a way that impairs its operation for others, for example through automated mass jobs outside the documented interfaces.
7. Data and data processing on behalf
How we process personal data is described in our privacy policy.
Where businesses use Sealed Print to process personal data for which they are the controller (e.g. contents of print jobs), we process it as a processor. For this we conclude a data processing agreement under Art. 28 GDPR, which we provide on request to [email protected].
8. Changes to the services
We continue to develop Sealed Print and may change services if this is reasonable for the customer, for example for reasons of security, changes in the law or technical developments, and the agreed core functions are preserved.
For consumers: if a change impairs access to Sealed Print or its usability more than insignificantly, we inform them in text form in good time beforehand. The consumer can then terminate the contract free of charge within 30 days under § 327r BGB.
9. Defects
The statutory provisions apply, for consumers in particular §§ 327 et seq. BGB on digital products. Please report defects to [email protected].
10. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and to the extent that we have given a guarantee.
In the case of slight negligence, we are liable only for breaches of essential contractual obligations, i.e. obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the customer may regularly rely. Liability is then limited to the foreseeable damage typical for the contract.
On the free plan Free, we are liable only for intent and gross negligence and in the cases of the first paragraph.
Sealed Print is not an archive. The customer keeps the originals of their documents; for loss of data we are liable only up to the effort that would have been required for recovery if the customer had backed up the data regularly.
11. Changes to these terms
We may change these terms with effect for the future if the law, case law or our services change. We announce changes in text form at least six weeks before they take effect.
For businesses, a change is deemed approved unless they object before it takes effect; we point out this consequence in the announcement. We ask consumers for their consent. If the customer objects or does not consent, the contract continues on the previous terms; we may then terminate it with notice.
12. Right of withdrawal for consumers
For paid plans, consumers have a right of withdrawal in accordance with the following withdrawal policy.
13. Dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
14. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the country in which they have their habitual residence.
If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes is our registered office in Achim, Germany.
Should individual provisions be invalid, the remainder of the contract remains valid; the statutory provisions take the place of the invalid provisions.
Withdrawal policy
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day the contract is concluded.
To exercise the right of withdrawal, you must inform us (Tiny Tools Microservices GmbH, Fichtenweg 12, 28832 Achim, phone +49 4202 9919813, email [email protected]) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated us your withdrawal from this contract, in comparison with the full coverage of the contract.
